1. Scope

  1. These General Terms and Conditions apply to all contracts concluded with the Augustusberg – Hotel Restaurant (hereinafter referred to as the Hotel), as well as to all related other services and deliveries from the Hotel to the customer (hereinafter referred to as the Organizer), as well as the use of the hotel rooms, event rooms and the wellness area.
  2. The subletting and further rental of the rooms, spaces and areas provided as well as invitations to interviews, sales or similar events require the prior written consent of the hotel. If the customer is not also the organizer or if he orders at the expense of another person, both parties are jointly and severally liable.

2. General rules for booking hotel rooms

  1. Reservations and options
    1. Reservations are binding for both parties. The contract cannot be terminated unilaterally. Cancellation is only possible with the consent of the hotel.
    2. Option dates are binding for both contracting parties. The hotel reserves the right to sell the reserved rooms and all other services elsewhere after the option dates have expired.
    3. A non-binding option expressly designated as such must be made binding or returned no later than 30 calendar days before the day of arrival. Confirmed options are treated as firm reservations. Without timely binding confirmation of the option, the hotel is entitled to allocate the reserved service to someone else.
  2. Advance payments and tariffs
    1. The hotel is entitled to demand an appropriate advance payment or security deposit upon conclusion of the contract or thereafter.
    2. Services and tariffs are freely determined by the owner.
    3. The hotel is entitled to request an advance payment from the guest upon arrival. The hotel reserves the right to request payment of an interim invoice from the guest after one week or after a turnover of €500 or more.
    4. If a customer does not accept contractual services that he has ordered or reserved in advance, he remains obliged to pay the agreed price in the following amount:
      • Cancellation conditions for room units per night (ZE) apply as follows:
        1. 01–02 ZE free of charge up to 5 days before arrival, up to 2 days before arrival 30%, thereafter 90%.
        2. 03–06 ZE free of charge up to 10 days before arrival, 30% up to 5 days before arrival, 90% thereafter.
        3. From 07 ZE up to 20 days before arrival free of charge, up to 10 days before arrival 30%, up to 5 days before arrival 50%, thereafter 90% of the total amount.
      • The hotel reserves the right to define different cancellation periods for certain seasons.
    5. The cancellation costs are based on the agreed price of the services ordered. Cancellation fees are reduced by the amount of accommodation that can be achieved by re-letting the cancelled rooms on the ordered date.
    6. Requests for room reservations made via the Internet must be confirmed as soon as possible. The hotel reserves the right to revise the bookings made within 24 hours if a parallel reservation has been made on site.
  3. Provision and payment
    1. Reserved rooms are available to the contracting party from 2:00 p.m. on the day of arrival. Unless a later arrival time has been expressly agreed, the hotel reserves the right to allocate booked rooms to other guests after 6:00 p.m.
    2. On the day of departure, rooms must be vacated by 11:00 a.m.
    3. Hotel bills are generally due upon departure in cash or by card without any discount.
    4. In case of late payment, the hotel is entitled to charge interest on arrears at a rate of 5% above the base interest rate applicable on the due date.

3. Prices

  1. The agreed prices include the applicable statutory value added tax and service charge.
  2. If the period between conclusion of the contract and the event exceeds four months and the price generally charged by the hotel for such services increases, the contractually agreed price may be increased appropriately, but by no more than 5%.

4. Customer withdrawal (cancellation, cancellation)

  1. A customer’s free withdrawal from the contract concluded with the hotel requires the hotel’s written consent. If this is not given, the agreed room rental and any other services ordered must be paid in any case, even if the customer does not use the contractual services and subletting is no longer possible.
  2. If a date for free withdrawal from the contract has been agreed in writing between the hotel and the customer, the customer can exercise his right of withdrawal up to that date.
  3. If the customer cancels between the 8th and 4th week before the event date, the hotel is entitled to charge 35% of the lost food sales in addition to the agreed rental price. If the cancellation occurs later, 70% of the food sales will be due.

5. Cancellation by the hotel

  1. If a right of withdrawal for the customer free of charge within a certain period of time has been agreed in writing, the hotel is entitled to withdraw from the contract during this period if other customers request the contractually booked event rooms and services and the customer does not waive his right of withdrawal when asked by the hotel.
  2. If an agreed advance payment is not made despite setting a deadline, the hotel is also entitled to withdraw from the contract.
